**Curricula:

Behind-the wheel (BTW) instruction must cover all topics outlined in 49 CFR

**Facilities:

Range facilities must comply with all applicable Federal, State, and local requirements.

**Instructors:

Behind-the-wheel (BTW) instructor means an individual who provides BTW training involving the actual operation of a CMV by an entry-level driver on a range or a public road and meets one of these qualifications:

The instructors have been evaluated and are in compliance with 49 CFR  as  outlined pursuant to the final ruling: Behind-the-wheel (BTW) instructor means an  individual who provides BTW training involving the actual operation of a CMV by  an entry-level driver on a range or a public road and meets one of these qualifications:  

If an instructor's CDL has been cancelled, suspended, or revoked due to any of the disqualifying offenses identified in § 383.51 of this subchapter, the instructor is prohibited from engaging in BTW instruction for 2 years following the date his or her CDL is reinstated.

  • I'm a Administrative per se (probable cause) for operating a CMV with a blood alcohol concentration at or above .04.paragraph.

  • Administrative per se (probable cause) for operating a motor vehicle with a blood alcohol con centration at or above .08.

  • Operating a CMV while your blood alcohol concentration is .04 or higher.

  • Operating a motor vehicle under the influence of alcohol.

  • Operating a motor vehicle under the influence of a controlled substance.

  • Refusal to take an alcohol test.

  • Leaving the scene of an accident.

  • Using a motor vehicle to commit a felony (not a traffic offense).

Instructor disqualification offenses

**State Licensing:

Be licensed, certified, registered, or authorized to provide training in accordance with the applicable laws and regulations of any State where in-person training is conducted.

The above named entity, as pursuant to the North Dakota Century Code, agrees to never charge a student for the training provided. Any person who violates this requirement is guilty of a Class B misdemeanor. Furthermore, your authorization to provide training may be revoked.

**Vehicles:

All vehicles used in the behind-the-wheel training must comply with applicable Federal and State safety requirements.

Training vehicles must be in the same group and type that driver-trainees intend to operate for their CDL skills test.

**Records:

Records must be retained for 3 years for auditing purposes.
